Terms and Conditions
01. Agreement
These Terms and Conditions govern your use of HK Social, operated by Hokela Interactive Africa Ltd., a company registered in Kenya.
By using our website, app, admin portal, ticketing tools, event access tools, payment flows, ticket download services, or related services, you agree to these Terms. If you do not agree, please do not use the platform.
02. The platform
HK Social provides technology for live event operations, including ticket sales, ticket delivery, attendee management, access control, cashless or wallet features, vendor tools, dashboards, analytics, and support services.
Unless we clearly say otherwise for a specific event, the event organiser is responsible for the event itself, including venue access, timing, programming, safety arrangements, seating, postponement, cancellation, admission rules, and event-specific refund rules.
03. Accounts and roles
Some features require an account. You agree to provide accurate, current, and complete information and to keep your login details secure.
Admin, vendor, scanner, operator, and organiser accounts may access sensitive operational information. These accounts may only be used for authorised event purposes, and their actions may be logged for security, audit, support, and accountability.
We may refuse, suspend, or terminate an account if we reasonably believe it is inaccurate, fraudulent, abusive, duplicated, compromised, or being used in breach of these Terms.
04. Tickets and payments
Tickets are subject to availability, event rules, pricing, ticket limits, eligibility rules, and successful payment confirmation. An order is complete only when payment is confirmed or the ticket is otherwise issued through HK Social.
Payments are processed through authorised payment providers or approved payment methods. Where payment confirmation is delayed, an order may remain pending until verification is complete.
We may cancel or reverse orders that appear fraudulent, duplicated, abusive, technically incorrect, issued in error, unpaid, charged back, or in breach of ticket limits or event rules.
05. Ticket delivery and access
Tickets may be delivered by email, in-app wallet, download link, QR code, NFC token, smart link, or another approved method. You are responsible for giving us accurate contact details for delivery and support.
Ticket numbers, QR codes, NFC tokens, download links, and other access credentials are security-sensitive. Do not share them publicly or transfer them outside approved channels.
Entry is subject to ticket validation and event rules. Duplicate, invalid, refunded, revoked, transferred, wrong-event, expired, already-used, or suspicious tickets may be refused.
06. Attendees and accessibility
If you provide attendee details for another person, you confirm that you have permission to share that information for ticketing, event communication, access control, security, and support.
Some events may require tickets to be assigned to named attendees. Admission may be refused if attendee details do not match the event rules.
Where accessibility, disabled-person, companion, or assisted-sale tickets are offered, reasonable eligibility or support information may be requested by us or the event organiser. Misuse of accessibility tickets may result in cancellation or refusal of entry.
07. Refunds and event changes
Refunds are governed by the event-specific refund policy, applicable law, and the event organiser's rules. Platform fees, payment processing fees, delivery fees, or service fees may be non-refundable unless required by law or expressly stated otherwise.
If an event is cancelled, postponed, materially changed, or rescheduled, the event organiser is primarily responsible for confirming the applicable remedy. We may help process refunds or credits where authorised to do so.
No refund is guaranteed for missed events, late arrival, denied entry due to breach of rules, incorrect buyer information, duplicate ticket use, or unauthorised resale.
08. Transfers and on-site services
Tickets may not be copied, resold, transferred, advertised, auctioned, or commercially exploited unless HK Social or the event organiser expressly allows it.
Where official resale or transfer features are available, you must use only those approved channels.
If an event uses cashless payments, wallet balances, top-ups, vendor purchases, or on-site ordering, balances, refunds, reversals, and unused funds are handled under the applicable event policy and payment-provider rules.
09. Acceptable use
Do not use HK Social for fraud, unlawful activity, money laundering, prohibited sales, or anything our payment partners forbid.
Do not bypass ticket limits, queues, payment checks, access controls, or security measures; copy, forge, alter, sell, or misuse tickets or access credentials; scrape, overload, reverse engineer, or attack the platform; upload harmful code; impersonate anyone; misuse personal data; or abuse refunds, chargebacks, promotions, or support channels.
We may suspend or restrict access where needed to protect users, event organisers, the platform, payment flows, or event operations.
10. Intellectual property
The HK Social platform, software, branding, designs, databases, text, graphics, logos, and related materials are owned by us or our licensors.
You may use the platform only for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the platform without written permission.
Event names, logos, images, and content may belong to event organisers or other third parties.
11. Availability and liability
We aim to provide a reliable service but do not guarantee uninterrupted, error-free, or always-available access. Maintenance, network issues, provider downtime, payment delays, high traffic, security incidents, or third-party failures may affect the platform.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages.
Where liability cannot be excluded, our liability is limited to the amount paid through HK Social for the affected ticket or service, unless applicable law requires otherwise.
12. Governing law and contact
These Terms are governed by the laws of Kenya, unless mandatory consumer protection law in another applicable jurisdiction requires otherwise.
Please contact us first so we can try to resolve any dispute informally. If it cannot be resolved, it may be referred to mediation, arbitration, or the competent courts of Kenya, depending on the dispute and applicable law.
